Accepting these Terms
By using rareandelite.com, submitting an application, creating an account, joining a waitlist or purchasing any service, you agree to these Terms, our Privacy Policy, our Health and Fitness Disclaimer and, where applicable, our Membership and Billing Terms and Cancellation and Refund Policy.
Eligibility
You must be at least 18 years old to apply, create an account or purchase any service. By using our services you confirm that you meet this requirement.
Our services
RARE + ELITE offers application-only private coaching and may in the future offer subscription memberships. Services may include workout programming, nutrition education, habit and accountability coaching, progress tracking, check-ins and AI-assisted recommendations based on content approved by RARE + ELITE.
Private coaching is available only to accepted applicants. Submitting an application does not guarantee acceptance. Membership products shown as "coming soon" are not yet available for purchase.
Not medical, mental-health, legal or financial services
RARE + ELITE does not provide medical diagnosis, treatment, therapy, mental-health counseling, legal advice or financial advice. Our coaching is educational and supportive in nature. See the Health and Fitness Disclaimer for details.
No guaranteed results
Results depend on many factors, including your effort, consistency, health, genetics and circumstances. Client stories on our website reflect individual experiences and are not promises of any outcome.
AI-assisted recommendations
Some features may use artificial intelligence to generate suggestions from content approved by RARE + ELITE. AI-generated content may be incomplete or inaccurate, is not reviewed in real time by a coach, and is never a substitute for professional medical advice. AI features do not represent themselves as Patrick Neumiller or any individual coach.
Your account
You are responsible for keeping your login details secure and for all activity under your account. Provide accurate information, including honest answers to health and safety questions. We may pause or restrict access where your answers indicate a program may not be appropriate for you.
Acceptable use
You agree not to share your account, copy or resell our programs or content, upload unlawful or infringing material, interfere with the website, or misuse other members' information.
Intellectual property
All programs, workouts, meal guidance, videos, text, graphics and branding are owned by or licensed to RARE + ELITE and are provided for your personal, non-commercial use only.
Your content
You keep ownership of content you submit, such as progress photos, notes and check-in answers. You grant us a limited license to use it solely to deliver and improve your coaching. We will not publish your photos, name or story without your separate written permission.
Payments
Paid services are subject to the Membership and Billing Terms and the Cancellation and Refund Policy. Private coaching investments are confirmed individually with accepted clients.
Limitation of liability
To the fullest extent permitted by law, RARE + ELITE and RARE AND ELITE LLC are not liable for indirect, incidental or consequential damages, or for injury, illness or loss arising from your participation in any physical activity or nutrition change. To the maximum extent permitted by law, our total liability is limited to the amount you paid us during the preceding 12 months.
Termination
We may suspend or end access for violations of these Terms or for safety reasons. You may stop using our services at any time, subject to any commitment you agreed to.
Governing law and disputes
These Terms are governed by the laws of Tennessee. Before pursuing a dispute, contact coach@rareandelite.com and allow 30 days for informal resolution. These Terms do not require mandatory arbitration or include a class-action waiver.
Changes
We may update these Terms. Material changes will be posted on this page with a new effective date and, where appropriate, sent by email.
